New Countries On FATCA: India & UAE… What This Means For You!

If you are a regular reader of my blog ~ you know the tax geek that I am, I write a lot about tax compliance for foreign bank account holders and the effect of the FATCA. FATCA stands for Foreign Account Tax Compliance Act. Calling a spade a “large digging instrument”, we know this law is one-sided and forces other countries to enforce US tax laws. And if they fail to comply, they are effectively locked out of US markets and the US dollar ~ the “world currency” for now.

Countries that sign the FATCA Agreement or Inter Governmental Agreement (IGA) are considered tax compliant. This means the banks/ foreign financial institutions (FFI) in these countries send information as demanded by the IRS to their own tax authorities which is then shared with the IRS. Rand Paul Files Federal Lawsuit Against U.S. Treasury And IRS Over IGA’s

Kentucky Senator and 2016 Republican Presidential hopeful Rand Paul recently announced that, in partnership with Republicans Overseas and five others, he would head to court to stop the vile Foreign Account Tax Compliance Act crackdown. At the risk of comparing the noted Republitarian/Libripublican figure with a certain single-cell cartoon villain, the effort may turn out like the video below.

The lawsuit, which was filed in an Ohio federal court, actually contains some pretty good arguments. In any other environment, this lawsuit might go somewhere. But they say that timing is everything, and the timing is just all wrong.

IRS Issues Final Regulations On Reporting Financial Assets

Individuals who are required to report interests in foreign financial assets to the IRS got guidance on the process in the form of final regulations on Thursday (T.D. 9706). The regulations finalize temporary regulations (T.D. 9567) issued in 2011, with some changes.

Sec. 6038D, enacted as part of the Foreign Account Tax Compliance Act, requires individuals to report interests in specified foreign financial assets (SFFAs) when filing their federal income tax returns for tax years beginning after March 18, 2010, using Form 8938, Statement of Specified Foreign Financial Assets. FATCA FFI List Resources And FFI List FAQs Are Now Available

The FATCA FFI List Resources and Support Information and the FATCA FFI List Frequently Asked Questions (FAQs) have both been posted to the FATCA Website.

What taxpayers representatives should be paying attention to in these FATCA discussions, among other things, is that the form of the FATCA submissions entitled “Schema” is a uniform computer readable report. This is the same language/requirement which is being utilized in discussions regarding intergovernmental agreements.
