The child and dependent care credit is figured on form 2441. The child must be under 13 years old, unless disabled. The credit is based on a maximum of $3K per child or $6K per return. The credit may only be taken by the parent who the child lives with for the majority of the year, normally the custodial parent. If the court has given the dependency deduction to the non-custodial parent they may not take the credit even if they pay the expenses. The custodial parent may take the expenses they pay even if they are not claiming the dependent deduction.
