Many states have enacted laws that expand the definition of applying nexus to their state. There has been a general trend to move beyond physical determinations of nexus i.e. employees, facilities, storing of assets within a state to “economic nexus”. Economic nexus asserts that an out of state seller who earns a substantial amount of revenue from a state above a certain threshold, i.e. $500,000, the seller is automatically deemed to have a presence in that state.
