Mail him the 1099 form, by certified mail. Mail the original to IRS. As far as you are concerned, you have fulfilled your responsibility. Whatever he does with it is his responsibility. You still deduct the amount on your return. If you do not issue it at all, then no deduction. If you send to IRS, but not to IC, you will get hit with penalties, and so will he for not claiming the income.
