Your residency status is based on the substantial presence test, which takes into account the number of days you have been present in the U.S. during the current year and the two previous years. Certain visa holders in the U.S. are exempt from this test and are considered nonresidents.
To determine your status through an interactive interview form, go to www.form1040nr.com and select Your Tax Residency in the header. After completing the interview and reviewing the results, please let me know if you have questions about your status.
