I am assuming that the taxpayer in question has committed some significant federal tax fraud or evasion, or the question is beside the point.
1. Do not rely on any specific advice from on-line postings, including this one. (I am trying to keep my advice general)
2. Find yourself a good lawyer experienced in such matters. (This will be expensive, but cutting corners here may be even more expensive).
3, The general rule is, yes, they can still nail you even if you cooperate, but assuming you can give them information about other tax crimes committed by other people, this is less likely. If it's only about your own schemes or misdeeds, you may not have much to give them. In that case, sentencing is likely to be governed by federal guidelines, but the skill of your lawyer may help you. I haven't gotten involved in this since I stopped practicing law some 10 years ago so things may have changed.
